1)         Mr. James metalworker was charged, tried and finally acquitted of the 1st degree death penalty of Jane Clement in Victoria in 1978. Three months agone as a result of new D.N.A. testing of derivation found at the murder scene, the Crown Prosecutor is today confident that Mr. smith may now be convicted. Mr. Smith has now been arrested and charged with the murder of Jane Clement. Mr. Smiths legal philosophyyer has petitioned the Supreme hail of B.C. to throw out the charges once against Mr. Smith as they violate his engross Rights. What is your decision?

Section 11(b) states:

Any person charged with an offence has the reclaim if finally acquitted of the offence, not be tried for it again and, if found guilty and punished for the offence, not be tried for it again.
